Privacy Policy
This Privacy Policy explains how MyPlots LLC (“MyPlots,” “we,” “us,” or “our”) collects, uses, discloses, sells, shares, and otherwise processes information about you when you use our websites, including www.myplots.com, our mobile applications, and our related services (together, the “Service”). By using the Service, you agree to this Policy, which is incorporated into and subject to the MyPlots Terms of Service. If you do not agree, please do not use the Service.
Your privacy choices
You have real control over your information. Depending on where you live, you may have the right to access, delete, or correct your data, to opt out of the sale or sharing of your personal information, and to limit how we use your sensitive personal information.
If you are a California resident, you can exercise these rights at any time using the links below or in your app settings, and we honor Global Privacy Control signals sent by your browser.
Section 01
Scope and your choices
This Policy applies to everyone who uses the Service, including event attendees, event organizers, hosts, and promoters. Throughout this document we explain what we collect, why we collect it, who we share it with, and the choices and legal rights you have over your information.
Wherever you see a reference to your rights, you will also find how to exercise them. The most important controls — including the ability to opt out of the sale or sharing of your personal information and to limit the use of sensitive personal information — are available in the footer of our website and in our app settings, and are described in full in Sections 11 and 12.
Section 02
Definitions
To keep this Policy clear, a few terms carry specific meanings. “Personal Information” (or “Personal Data”) means information that identifies, relates to, describes, or could reasonably be linked, directly or indirectly, with a particular individual or household. “Sensitive Personal Information” is the narrower set of data treated as sensitive under applicable law, such as precise geolocation, government identifiers, and account login credentials.
“Sale” means disclosing Personal Information to a third party for monetary or other valuable consideration, and “Sharing” means disclosing Personal Information to a third party for cross-context behavioral advertising, whether or not money changes hands. A “Service Provider” (or “Processor”) is a company that processes Personal Information on our behalf and under our instructions. “Usage Data” is information collected automatically as you use the Service, and a “Consumer,” for purposes of California law, is a natural person who is a California resident.
Section 03
Information we collect
We collect information that you provide directly to us. This includes identifiers such as your name, email address, phone number, postal address, and account username, as well as profile and event information such as the events you create, host, attend, save, or buy tickets to, along with your preferences, profile photo, and descriptions of your activity. We also collect commercial information about your ticket purchases and transaction history, the contents of messages and support requests you send us, and — if you are an organizer or host — the business and payout details you provide so we can enable payments through our payment processor.
We also collect certain information automatically when you use the Service. This Usage Data includes your device and network information, such as your IP address, device identifiers, operating system, and browser type and version, together with activity information such as the listings and pages you view, the time and date of your visits, how long you spend, your referral source, and diagnostic data. We collect some of this information using cookies and similar technologies, which are described in Section 7.
On our mobile app, we collect additional information only with your permission. With your consent, we may access your precise geolocation to surface nearby events, and your camera and photo library so you can upload images. You can turn these permissions on or off at any time in your device settings.
Finally, we may receive information from third parties. If you register or log in through a third-party social media service, we may receive your name, email address, profile information, and other data that the service makes available, and we may receive information from analytics, advertising, and fraud-prevention partners.
For the purposes of California law, in the past twelve months we have collected the following statutory categories of Personal Information: identifiers; customer records information; commercial information; internet and network activity; geolocation data; audio and visual information such as uploaded photos; and inferences drawn from the information above. The only sensitive personal information we collect is precise geolocation, where you grant permission, and account login credentials.
Section 04
How we use your information
We use your information to provide, operate, maintain, and improve the Service and to monitor how it is used. This includes creating and managing your account and authenticating you, processing ticket purchases, payouts, and other transactions, and otherwise performing our contract with you. We use your contact information to communicate with you by email, SMS, push notification, or phone about your account, your transactions, security matters, and updates to the Service.
With your information we also send marketing and promotional messages about events, offers, and features, which you can opt out of at any time, and we personalize the content and recommendations you see. We use information to deliver, measure, and improve advertising, including interest-based and cross-context behavioral advertising, and to conduct analytics, identify usage trends, and measure how effective our campaigns are.
We rely on your information to detect, prevent, and investigate fraud, abuse, and security incidents, to comply with our legal obligations and enforce our agreements, and to evaluate, negotiate, or complete a merger, financing, acquisition, reorganization, or sale of assets. We will not use sensitive personal information for purposes beyond those you would reasonably expect without first giving you notice and the ability to limit that use.
Section 05
How we disclose your information
We disclose Personal Information to service providers who process it on our behalf, such as our hosting, payment processing, analytics, email and SMS delivery, and customer support vendors. We disclose attendee information to the event organizers and hosts whose events you interact with, to the extent they need it to fulfill and manage those events, and we disclose information to advertising and analytics partners for the purposes described in Sections 7 and 12.
Where you post or share information in public areas of the Service, other users may see it. We may disclose information to our affiliates under common control with us, who are required to honor this Policy, and to business and promotional partners so they can offer you products, services, or promotions. We will also disclose information to authorities or other parties where required by law or legal process, or to protect rights, safety, and property, and to a successor entity in connection with a business transfer as described in Section 13.
Our key service providers and vendors include Stripe for payments, Amazon Web Services for hosting, and Amazon SES for email, along with advertising partners that may include Meta (Facebook and Instagram), Google, Microsoft (Bing), X (formerly Twitter), and Pinterest. Each of these companies processes data under its own privacy policy.
Section 06
Payments
Payment card details are collected and processed directly by our third-party payment processor, Stripe, and are not stored by MyPlots. Our payment processors are PCI-DSS compliant, and your use of payment services is also governed by the processor’s own privacy policy.
Section 08
Data retention
We retain Personal Information only for as long as necessary for the purposes described in this Policy, including providing the Service, complying with our legal obligations, resolving disputes, and enforcing our agreements. Usage Data is generally kept for shorter periods, except where we need it for security, functionality, or legal compliance. We determine retention periods based on the nature and sensitivity of the data, the purpose for which we hold it, and the requirements of applicable law.
Section 09
Data security
We use commercially reasonable administrative, technical, and physical safeguards designed to protect your Personal Information. No method of transmission over the internet or method of electronic storage is completely secure, however, and we cannot guarantee absolute security.
Section 10
International data transfers
We are based in the United States and process information here and in other places where our service providers operate. If you access the Service from outside the United States, you understand that your information may be transferred to and processed in the United States, where data-protection laws may differ from those in your jurisdiction, and we implement appropriate safeguards for such transfers where they are required.
Section 11
Your U.S. state privacy rights
California (CCPA, as amended by the CPRA)
If you are a California resident, you have the right to know and access the categories and specific pieces of Personal Information we collect, use, disclose, sell, and share; to delete Personal Information we have collected, subject to legal exceptions; and to correct inaccurate Personal Information. You also have the right to opt out of the sale or sharing of your Personal Information, to limit the use and disclosure of your sensitive personal information to what is reasonably necessary to provide the Service, and, where applicable, to opt out of automated decision-making technology used for significant decisions and to access information about how it works. Finally, you have the right not to be discriminated against for exercising any of these rights; we will not deny you service, charge you a different price, or give you a lower quality of service because you exercised a right, except where a difference is reasonably related to the value of your data and disclosed to you as a financial incentive.
To submit a request, you can use the links in our website footer and app settings, or email us at [email protected]. We will verify your identity before fulfilling requests to access, delete, or correct information, though opt-out requests do not require verification, and you may use an authorized agent to submit a request on your behalf with proof of authorization. We will acknowledge requests within ten business days and respond within forty-five days, which we may extend by an additional forty-five days with notice.
Other U.S. states
If you live in a state with a comprehensive privacy law, including Virginia, Colorado, Connecticut, Utah, Texas, Oregon, and others, you have similar rights to access, delete, correct, and obtain a portable copy of your data, and to opt out of targeted advertising, the sale of personal data, and certain profiling. To exercise these rights, contact us using the methods above. Where the law requires it, we provide a process to appeal a denied request, and if your appeal is denied you may contact your state Attorney General.
Section 12
Sale and sharing of personal information
We sell and share Personal Information as those terms are defined under California law. In practice, we share identifiers, internet and network activity, commercial information, and inferences with advertising and analytics partners for cross-context behavioral advertising and measurement, and this activity may qualify as a “sale” or “sharing” under the CCPA and CPRA. The categories we may sell or share are identifiers, commercial information, internet and network activity, and inferences, and we disclose them to advertising networks, analytics providers, and marketing partners.
You can direct us to stop selling or sharing your Personal Information at any time. You can click the “Do Not Sell or Share My Personal Information” link in our website footer or app settings, enable a Global Privacy Control signal in your browser, or email us at [email protected]. You do not need an account to opt out. Once you opt out, we will not sell or share your Personal Information unless you later authorize it, and we will wait at least twelve months before asking you to opt back in. We do not knowingly sell or share the Personal Information of consumers under sixteen years of age without opt-in consent, as described in Section 14.
Section 13
Business transfers
We may transfer, sell, or assign Personal Information in connection with, or during negotiations of, any merger, acquisition, financing, reorganization, bankruptcy, dissolution, or sale of all or part of our business or assets, and Personal Information we hold about users may be among the assets transferred. We will provide notice, for example on the Service, before your Personal Information becomes subject to a materially different privacy policy. By using the Service, you acknowledge and agree that these transfers may occur and are permitted by this Policy and by applicable law.
Section 14
Minors and children
The Service is intended for users who are eighteen years of age or older, and you must be at least eighteen, or the age of majority in your jurisdiction, to create an account or use the Service.
We do not knowingly collect Personal Information from children under thirteen, and if we learn that we have, we will delete it, consistent with the federal Children’s Online Privacy Protection Act. We also do not knowingly sell or share the Personal Information of any consumer under sixteen years of age. Where the law permits the sale or sharing of a minor’s data only with affirmative consent, we will not engage in it without opt-in consent from consumers aged thirteen to fifteen, or parental or guardian consent for those under thirteen. If you believe a minor has provided us with Personal Information, please contact us at [email protected] and we will take appropriate action.
Section 15
Do Not Track
Some browsers offer a “Do Not Track” setting. Because there is no common industry standard for how to interpret these signals, we do not currently respond to Do Not Track signals. We do, however, honor recognized opt-out preference signals such as Global Privacy Control, as described in Section 7.
Section 16
Email and SMS marketing
You can opt out of marketing emails using the unsubscribe link in any message, and you can opt out of marketing text messages by replying STOP. While you maintain an account, you cannot opt out of transactional or service messages, such as receipts, security alerts, and account notices.
Section 17
Third-party links and services
The Service may link to or integrate third-party websites and services that we do not control. This Policy does not apply to those third parties, and we are not responsible for their privacy practices, so we encourage you to review their policies before providing information to them.
Section 18
Changes to this policy
We may update this Policy from time to time. When we do, we will revise the “Last Updated” date at the top and, where the law requires it, provide additional notice. Your continued use of the Service after changes take effect means you accept the updated Policy.
Section 19
Contact us
If you have questions or requests about this Policy or your Personal Information, you can reach us by email at [email protected].
